When You Get Your Decision

When the decision arrives, make sure that your lawyer has also received a copy. Although your lawyer is also supposed to receive a copy, occasionally the hearing office makes a mistake and fails to mail it to your lawyer. If this happens, your lawyer won’t know, for example, whether the decision contains an error. He or she also will not be able to monitor the payment of your benefit. Most importantly, your lawyer won’t know if you received a denial decision that needs to be appealed by a specific deadline. So be sure to call your lawyer’s office to make sure that your lawyer also received a copy.

If You Lost

Even good cases are sometimes lost. If you lose, always consult with your Raleigh disability lawyer right away to see if you can appeal. Do this as soon as possible because it is critical that you appeal to the Appeals Council within 60 days of the judge’s decision, or you will lose the right to appeal forever.

Attorney Fees

A typical Social Security disability retainer agreement may call for the attorneys’ fee to be 25% of back benefits up to a maximum amount of money that is set by the Commissioner of Social Security (currently $6,000). In that case, the Social Security Administration will withhold the appropriate attorney’s fee and, unless you or the judge objects, the SSA will transfer that amount to your lawyer. If your retainer agreement requires you to reimburse your lawyer for costs, you will have to pay those amounts directly to your lawyer.
